EKO SMILE Competition Terms – EEC TICKETS»

The limited liability company with the name “HELLENIC FUELS MINERAL OILS SINGLE-PERSON INDUSTRIAL AND COMMERCIAL COMPANY” (hereinafter referred to as “EKO SA or Organizer”), headquartered in Maroussi, 8A Himarras Street, is organizing a promotional activity/competition (hereinafter referred to as the “Activity”) with a draw (hereinafter referred to as the “Draw”) in accordance with the following terms:

Right to Participate – Conditions

1.1. The right to participate in the promotional action is open to those who have reached the age of 18, are residents of Greece and have legal capacity. Employees of the organizer, gas station owners/managers, as well as first-degree relatives of all the previous categories are excluded from participation in the competition.

1.2. A necessary condition for someone to take part in the promotional action, other than those defined above, is a) to have a personal account on Instagram, while participation in the promotional action presupposes and implies acceptance of Instagram’s terms of registration, its privacy and security policy and consequently the waiver of any relevant claim against Instagram in relation to this promotional action and b) to have fully completed their registration in the EKO Smile customer loyalty program via the promotional code: ALL STAR in accordance with its terms and conditions during the competition from 4/02/2025 to 06/02/2025.

1.3. Participation in the promotional action requires access to the internet by interested parties using their own technical means and the completion of registration in the EKO Smile program.

The “Organizer” does not undertake any obligation regarding the provision of, assistance with access to internet sites or the provision of facilities to any interested party. Access to the promotional website is permitted only under the operating conditions of the relevant server and the technical and other conditions and specifications. Furthermore, the “Organizer” is not responsible for any burden on the participating users for the above reasons.

1.4. Participation in this promotional action does not require the purchase of products from the Organizer or the risking of any amount of money in any way by the participants for the purpose of profit.

Duration

2.1. The duration of this promotional action begins on Tuesday 04/02/2025 at 15.00 and ends on Thursday 06/02/2025 at 23:59.

2.2. Entries submitted within the promotional time limits are considered valid and after the expiry date of the aforementioned promotional action, no entry will be accepted.

2.3. The Organizing Company reserves the right to modify, limit or extend the duration of the promotional action, by amending these terms. This modification will be effective automatically from its publication on the promotional action page.

2.4. Entries submitted after the expiry of the initial and/or shortened and/or extended deadline for participation in this promotional action, in accordance with the above, will be considered automatically null and void and will no longer have any effect against anyone, while they do not create any type of right in favor of the participant.

2.5. The Start and End Time of the promotional action, the time of active submission of the participation and receipt of any point, as well as the measurement of all indications related to the promotional action will be based on the electronic computers that will be used for this purpose by the Organizer and not on the respective indications of the participants’ computers.

Participation in the action

More specifically, in order to take part in this promotional action, each interested party is invited to register via the promotional code: ALL STAR in the EKO Smile loyalty program and to accept the terms of registration of the program that will be received by SMS in order to complete their registration. Entries submitted within the time limits of the promotional action are considered valid.

Gifts

The prize offered to be drawn in the Competition is defined in the relevant Instagram Post announcing the competition and includes a double ticket for the Greece-Germany match on 9/2/2025 at 17.00, at the Glyfada “Makis Liougkas” Sports Complex, for 5 lucky winners.

The gift that will be made available by the Organizer within the framework of this promotional action, is defined as above and its exchange with other gifts or its redemption with cash is excluded. Also, the gift is personal and non-transferable. In case of assistance due to force majeure, security reasons or other circumstances beyond the control of the “Companies” or third parties, the “Organizer” may and is entitled NOT to offer the Gift, in which case it will be exempted from any liability and will not be obliged to offer an alternative gift of any form and value.

Furthermore, it is clarified that the Organizer bears no responsibility and the winners do not retain any requirement, claim or right against it in the event that the competition cannot be held due to force majeure, such as, but not limited to, weather conditions, general strike, etc. Also, and only for the above reasons, the Organizer may and is entitled NOT to offer the winners the Prizes or other alternative prizes, in which case it will be exempted from any responsibility and will not be obliged to offer alternative prizes of any form and value.

Winners Announcement

5.1. The winners will be selected based on an electronic draw that will be carried out through an automated process and selection of random codes from the EKO Smile electronic platform on 07/02/2025 at 11.00 pm. The selected winners, whose details appear from their full registration with EKO Smile, will initially be informed after the draw by an associate of the Organizer at the contact details they have declared with EKO Smile and their tickets will be sent to them electronically on the same day.

The “Organizer” has the right to cancel the draw or change the date of its holding. The above electronic draw will select five (5) winners and five (5) alternate runners-up in the event that for any reason it is not possible to contact them or they do not accept their prizes.

5.2. In any case, any of the winners, at any stage – even during the stage of awarding the prizes – may be disqualified for the following reasons: (a) in case they do not meet these terms in their entirety, all of which are considered essential, (b) due to an impediment under these terms, (c) in case for any reason it is not possible to contact them within the predetermined deadlines set out in these terms and (d) if they do not present a legal document proving their identity and age upon receipt of the Prize.

Personal data – Declaration of consent

By registering with EKO smile as specifically defined in points 1 to 3 above, participants declare their understanding of these terms in their entirety and provide their express and clear consent, within the meaning of Regulation (EU) 2016/679 (General Data Protection Regulation), as applicable, to the collection of their personal data and their processing for the needs of carrying out the program, namely for the purposes of 1. organizing and completing the draw and 2. informing and communicating with participants and in particular the winners of the competition, exclusively regarding the program. The Organizing Companies will process the personal data of the participants exclusively and only for the above purposes of the program. The personal data of the participants will not be disclosed to third parties and will not be transmitted outside the European Economic Area. The personal data of the winners will be kept until the delivery of the Gift as above. After the delivery of the Gift, as defined in these Detailed Terms, the relevant data will be destroyed. The Organizer is the Data Controller of the participants’ personal data and processes only data relating to contact details (e.g. Instagram direct message, telephone number) and personal details of the participants (e.g. name, surname, location). Each participant has the right to access, update, correct, object to the further processing of their personal data and portability, as provided for in the General Data Protection Regulation. To exercise their rights, the participant may contact the Organizing Companies at the contact details set out below. At any time, the participant may freely withdraw their consent and request the deletion of their personal data. To withdraw his consent, exercise the other rights provided for by the legislation on the protection of personal data, as well as for any issue relating to this consent, the participant may contact the Companies using the following contact details:

Modification of Terms

The Organizer reserves the right to amend these terms, shorten or extend the duration of this promotional action or to revoke it with prior notice by any appropriate means, as well as to replace the gift with another of equal value at its discretion and in general to amend any term of the promotional action by timely informing the participants with an announcement via the page https://www.instagram.com/eko_greece/.

Organizer’s Disclaimer

8.1. The Organizer shall not be liable in the event that participants disregard the terms and the participants agree to fully indemnify the Organizer against any claims by any third party arising from any breach of these terms. The Organizer shall not be liable for any damage arising on INSTAGRAM and the page https://www.instagram.com/eko_greece/.

8.2. The Organizer bears absolutely no responsibility if, for reasons beyond its sphere of influence and control, the receipt of entries fails or is delayed or, finally, if the records kept by it are destroyed, partially or completely.

8.4. It is clarified that this promotional action is not carried out by Instagram, nor is it sponsored or otherwise sanctioned or associated with Instagram and therefore Instagram bears no responsibility for any claim or demand of a participant or any third party arising from or in connection with this Competition.

Acceptance of the terms – Consent

9.1. Participation in this promotional action presupposes and implies the unconditional acceptance of all terms and conditions herein.

9.2. Participants acknowledge and unconditionally accept that the operation of the above-mentioned page of the Organizer may be affected or temporarily interrupted due to network problems. More generally, participation in the promotional action may be subject to changes or interruptions that depend entirely on the capabilities of both the social networking website in question and the existing technology on which they are based and which are beyond the control and responsibility of the Organizer, which bears no responsibility for all the above reasons. If it is proven that a participant has been declared a winner in violation of the terms of this, by fraudulent means, he will not be awarded his prize or will automatically lose any right to possess it, and the Organizer in this case reserves all its rights against the said participant.

Participants do not have or acquire any rights whatsoever over the trademarks, names, indications, emblems and other distinctive signs of the companies and Instagram and any modification, publication, transmission, transfer, reproduction, distribution, presentation, linking, downloading or otherwise exploiting, in whole or in part, in any way or means for commercial or other purposes, without the prior written permission of the beneficiary, is prohibited.

Jurisdiction – Applicable Law

Any dispute arising in relation to this promotional action will be referred exclusively to the Courts of Athens and Greek Law will apply.

Publicity

These terms and conditions will be posted throughout the duration of the promotional campaign on the page maintained by the Organizer on the website https://www.instagram.com/eko_greece/.
